In recent years, arbitration has taken on a much more significant role as the optimal method to resolve disputes, with the Singapore International Arbitration Centre (“SIAC”) being one of the foremost venues chosen for international arbitration. As more investment continues to flow into South East Asia, international investors increasingly wish to protect their investments, and have the peace of mind that in the event of any disagreement or dispute, all sides can have their issues resolved at a transparent, neutral and impartial forum.
The seminar will provide a comprehensive overview of the SIAC Arbitration Rules (6th Edition, 1 August 2016) and illustrate examples of how the Rules have been implemented in practice to efficiently resolve contractual disputes, and secure investment into jurisdictions that international investors have traditionally been cautious about making large scale capital inflows into. The presentations will be followed by a panel discussion on construction arbitration in Thailand, focusing on the increasing use of arbitration in Thailand to resolve construction disputes.

Angela Yap

Angela graduated with a LL.B. (Hons) from Oxford Brookes University and was called to the bar of England and Wales by the Honourable Society of Lincoln’s Inn in 2010. She is admitted to practice as an Advocate & Solicitor of the High Court of Malaya. Prior to joining SIAC, Angela practiced commercial litigation and arbitration and was a Senior Associate in the Dispute Resolution Division of one of the leading law firms in Malaysia.
Rashane Leerabandhu
Partner, DFDL Thailand
Rashane has been in practice for over 30 years, gaining extensive legal experience as in-house counsel in major Thai corporations as well as counsel in leading international law firms such as Baker McKenzie, Clifford Chance, PricewaterhouseCoopers, and Herbert Smith Freehills. Prior to joining DFDL, Rashane was Head of the Corporate and Commercial practice at Herbert Smith Freehills in Thailand. Rashane is a member of the Thai Bar and holds an LL.B. from Thammasat University and an LL.M. from the University of London (London School of Economics). He has special expertise in corporate finance, mergers and acquisitions, capital markets, mutual funds and real estate development and construction finance as well as infrastructure projects He regularly represents clients on acquisitions and developments in the hospitality, insurance, healthcare, and real estate sectors. Recently, he acted as local counsel on an aircraft financing matter for a major leasing company and represented a major airline in forming a joint-venture to launch a domestic airline in an ASEAN country. He has also taken a leading role in advising a French contractor in a competitive bidding for monorail projects in the greater Bangkok area. Rashane is a partner and leads the Corporate and Commercial Practice Group in Thailand.
Victor Smith
Chartered Arbitrator, Chartered Quantity Surveyor & Chartered Construction Manager
Victor is recognized as one of the leading arbitrators in Thailand. To date he has received over 80 appointments to act as an arbitrator or represent parties in international and domestic arbitration cases. He has sat as an arbitrator in England, Malaysia, Nepal, Singapore, Thailand and Vietnam. He has conducted arbitrations under English, Malaysian, Nepalese, Singaporean, Thai and Vietnamese laws and has sat as an arbitrator in proceedings conducted under the arbitration rules of the ICC, SIAC, TAI, VIAC, Board of Trade of Thailand and ad-hoc arbitrations under the UNCITRAL rules. He is a Fellow of the Chartered Institute of Arbitrators and the Thailand Branch of the Institute. He is the Chair of the Commission on Arbitration for ICC Thailand. He is a listed arbitrator with numerous arbitral institutions. Victor is a British Citizen and has permanent resident status in Thailand. He has lived and worked in Thailand for over 26 years. He graduated from Kingston Polytechnic with a BSc in Quantity Surveying and graduated from Northumbria University with an LLM in International Commercial Law (Distinction). He also holds a Post Graduate Diploma in Arbitration and a Diploma in International Commercial Arbitration. He is a member of the Society of Construction Law in the UK.
Audray Souche
Partner; Managing Director, DFDL Thailand
Audray Souche is a Partner and the Country Managing Director of DFDL Thailand. She has been working in the region since 2004, combining general commercial/foreign investment experience with specialized experience focusing on energy, mining and infrastructure projects. As the Deputy Head of the Regional Energy, Mining and Infrastructure Practice Group (since 2012), she leads DFDL teams on numerous energy project development, financing and technical assistance matters in the Lao P.D.R., Cambodia, Myanmar, Thailand, Vietnam, Nepal, and Bhutan. Audray is the Head of the Clean Energy Division and has extensive experience on development and financing of renewable projects across the region.
As Managing Director of DFDL Thailand, she manages the team members in Bangkok, Phuket, and Samui. In addition to her work on numerous renewable energy matters in Thailand, she also continuously supervises general market entry regulatory assessments, foreign investment structuring and restructuring, due diligence and risk assessment, merger and acquisition and private equity transaction works in retail, hospitality, manufacturing, insurance, mining, and aviation.
Audray has worked in DFDL’s Phnom Penh, Vientiane, and Ho Chi Minh City offices. She has been based in DFDL’s Bangkok office since 2012.
